All course materials, including presentations, outlines, instructions, recordings, and similar materials (“Course Materials”), are protected by U.S. copyright law. Owner is the exclusive owner of the copyright in those materials. You may take notes and make copies of course materials for your own use. You may also share those materials with another purchaser who has legally obtained the Course Materials.

You may not reproduce, distribute, display, post, upload or disseminate the Course Materials in any other way — whether or not a fee is charged — without the express written consent of Owner.  You also may not allow others to do so.

Use or Distribution of Recordings of Course Presentations - Except as provided herein, no business, association, agency, or individual, shall give, sell, or otherwise distribute to others or publish any recording made of or during any course presentation without the written consent of the Owner. This policy is applicable to any recording in any medium, including video, audio, handwritten or typed notes. 

Exceptions Related to Attachment/ Somatic-Informed EMDR Intensive Workbook and IFS-Informed EMDR Intensive Workbook – The Workbooks are intended for the sole use by the purchaser and are not permitted to be sold or resold to any third party. The entity or individual who has rightfully and validly purchased a Workbook is permitted by the Owner to distribute the Workbook materials to their patients for the intended use as described within each Workbook. The Workbook and any of the materials within it may not be reproduced, distributed, or transmitted in any form with the intention to sell all of or any portion of such materials or to be used outside of each Workbook's intended application (ie: by the purchaser for their patients).

Indemnification.  By using and or implementing the course materials or Intensive Workbooks (collectively, the “ACD Materials”) you will at all times indemnify, defend, and hold harmless Attuned Consultation & Development, LCC (“ACD”), its managers, directors, officers, employees, agents, licensees, successors, and assigns from and against any and all third party claims, damages, liabilities, or expenses, including reasonable attorney’s fees, arising out of any damages as a result of your, your company’s, or your businesses’ use or implementation of the ACD Materials. If ACD shall seek indemnification, you agree to give ACD the right to participate in the defense and settlement of any such claim; provided, however, that you may not, without ACD's prior written approval, settle or dispose of any claim of which you have agreed to accept the defense.

Exculpation. You expressly waive any and all claims against ACD, direct or indirect, including, without limitation, claims relative to the use and/or implementation of the ACD Materials by you, your company, your business. Furthermore, you agree that ACD shall not be liable to you, your company, your business or any third party for any injury sustained by the you, your company, your business, its employees, independent contractors, invitees, patients, students, or any other third party through the use or implementation of the ACD Materials. 

Please note there are no refunds on any digital products or courses.

Medical Disclaimer (Course Material) 

Attuned Consultation & Development (“ACD”) is not, nor is it holding itself out to be, a qualified doctor/physician, nurse, physician’s assistant, psychiatrist, psychotherapist, social worker, or any other medical or mental health professional (“Medical Provider”). ACD's website, blog, resources, courses, text, treatments, dosages, outcomes, charts, profiles, graphics, photographs, images, advice, messages, forum postings, and related content (collectively, “Materials”) includes information and instruction relating to, non-exclusively, treatment protocols, case conceptualization, navigating complex clinical cases, and new research developments, (collectively, “ACD Content”). Under no circumstances is ACD responsible for the claims of third-party websites or educational providers. Medical information changes constantly. Before using, relying upon, or participating in any of the ACD Content or ACD Materials, it is recommended that you consult with a Medical Provider. You acknowledge that you are participating voluntarily in using the ACD Materials and accessing ACD Content and that you are solely and personally responsible for your choices, actions, and results, now and in the future. You accept full responsibility for the consequences of your use, or non-use, of the ACD Content provided on or through the ACD Materials, and you agree that you are not relying upon the ACD Content or ACD Materials to implement any idea, suggestion, or recommendation in any way.

The role of ACD is to support and assist, however ACD does not predict and does not guarantee that a particular result will or can be attained. Any results based upon the use of the ACD Content or ACD Materials depends upon numerous factors and may vary. You fully agree that there are no guarantees as to the specific outcome or results you may expect from using, accessing, or relying upon the ACD Content or ACD Materials.
